MindSphareIT Terms of Service

1. Agreement to Terms & Nature of Service

By accessing or utilizing any tool on MindSphareIT (including our web platform, browser extensions, and developer APIs), you agree to be bound by these Terms of Service. MindSphareIT is a client-side conversion utility designed to assist users in accessing, archiving, and transcoding publicly available web media for personal, non-commercial, and educational fair use.

2. Acceptable Use & User Warranties

When utilizing our media extraction pipeline, you warrant that:

• You are authorized to view and download the requested content under the Fair Use Doctrine (17 U.S. Code § 107) or with explicit rights from the content creator.
• You will not use automated scraper bots, distributed stress scripts, or unauthorized programmatic exploits to overwhelm MindSphareIT server clusters.
• You will not redistribute, resell, broadcast, or commercially monetize media downloaded through MindSphareIT without proper commercial licensing from the rights holder.

3. Digital Millennium Copyright Act (DMCA) & Takedowns

MindSphareIT respects all intellectual property rights and adheres strictly to the Digital Millennium Copyright Act (DMCA). Because MindSphareIT does not host, store, cache, or maintain any video or audio files on persistent disks, all content is directly transcoded from the third-party origin servers.

If you are a copyright owner or authorized representative and wish to block your domain or specific media links from being processed through our system, you may submit a takedown request to our engineering team with the following details:

• Identification of the copyrighted work claimed to have been infringed.
• Specific URLs or domain patterns requested for blacklist enforcement.
• Your contact information (name, address, telephone number, and email address).
• A statement made under penalty of perjury that the information in the notification is accurate.

4. Disclaimer of Warranties & Limitation of Liability

MindSphareIT is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. MindSphareIT does not guarantee uninterrupted service, instantaneous stream parsing across third-party API changes, or complete availability of third-party video platforms that frequently alter their internal obfuscation layers.

In no event shall MindSphareIT, its developers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your access to or use of the service.
